Terms of Service & Sales Policy

All subscriptions are billed according to the selected plan duration:

• AI Agent Plans: 14-month subscription period
• Add-on Services: 14-month subscription period
• Multi-Tone Premium Hz: Monthly subscription (250 HXNI per month)
• Zenith AI Chat: 7 free questions per day per IP for visitors — unlimited for subscribers
• All prices are in HEXANAI TOKENS (HXNI) - converted to your preferred currency at checkout

Users may upgrade their subscription plan at any time subject to the following conditions:

• A 30% penalty fee applies to all mid-subscription plan changes
• The penalty is calculated on the remaining value of the current subscription
• Users must pay the full price of the new plan plus the penalty
• The new subscription period starts from the date of upgrade

Add-on services can be purchased at any time:

• Available from the user dashboard or the main website
• No penalty applies to add-on purchases
• Add-ons are billed separately from the main subscription
• Each add-on has its own 12-month subscription period

We accept the following payment methods:

• Credit Cards (Visa, Mastercard, American Express)
• Debit Cards

Note: PayPal, Google Pay, and Apple Pay are not currently accepted.

Due to the nature of digital services:

• No refunds are provided after service activation
• A 14-day cooling-off period applies before service activation
• Users may cancel during the cooling-off period for a full refund

To ensure fair usage and system performance:

• AI Chat: Limited to reasonable daily usage based on subscription tier
• Zenith AI: 7 free questions per day per IP — resets at midnight UTC
• Usage resets daily at midnight UTC
• Abuse of AI services may result in account suspension

In accordance with GDPR regulations:

• Users may request a copy of their personal data at any time
• Users may request deletion of their account and all associated data
• Deletion requests are processed within 30 days

Our AI systems are designed to:

• Never discuss politics, religion, or controversial social topics
• Never make assumptions about age, gender, or personal characteristics
• Provide neutral, empathetic, and constructive guidance
• Focus solely on the user's stated needs and goals

You must provide accurate, complete, and up-to-date information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Each account is personal and non-transferable unless you hold a B2B or multi-seat subscription.

Creating multiple accounts to circumvent usage limits is prohibited and may result in termination of all associated accounts. Notify us immediately at hexanai@pm.me of any unauthorised access.

You agree not to use our services to:

• Generate, distribute, or store content that is unlawful, defamatory, abusive, harassing, threatening, obscene, or otherwise objectionable;
• Violate any applicable local, national, or international law, including intellectual property rights, privacy laws, and export control regulations;
• Generate misinformation, deepfakes, or content designed to deceive or manipulate;
• Reverse-engineer, decompile, or attempt to extract source code or model weights from our systems;
• Use automated tools, bots, or scripts to scrape, crawl, or extract data without prior written consent;
• Circumvent, disable, or interfere with security features, rate limits, or access controls;
• Resell or commercially exploit AI outputs from our services without prior written authorisation;
• Use our services to build competing products without explicit written permission.

Violations may result in immediate account suspension or termination without refund, and may be reported to relevant law enforcement authorities.

Our AI systems generate responses based on machine learning models. While we strive to deliver accurate, high-quality outputs, we make no warranties — express or implied — regarding the accuracy, completeness, reliability, or fitness for a particular purpose of any AI-generated content.

AI outputs must not be construed as professional legal, financial, medical, psychological, or other regulated advice. Always consult qualified professionals before making decisions in these domains. HEXANAI expressly disclaims all liability for decisions made based on AI-generated content.

To the fullest extent permitted by applicable law, HEXANAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of your use of, or inability to use, our services.

All intellectual property rights in the HEXANAI platform — including software, algorithms, design, trademarks, AI models, and documentation — are owned by or licensed to HEXANAI and are protected under applicable law. We grant you a limited, non-exclusive, non-transferable, revocable licence to access our services for personal or internal business use.

You retain ownership of content you submit ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to process and store such content solely for the purpose of providing our services.

You may terminate your account at any time by contacting hexanai@pm.me. Upon termination, your right to access our services ceases immediately. Remaining subscription time is non-refundable unless otherwise required by applicable law.

We reserve the right to suspend or terminate accounts immediately, without notice, for violations of these Terms, fraudulent activity, or risk to other users or our systems. Provisions that by their nature should survive termination — including intellectual property, disclaimers, indemnification, and liability limitations — shall survive.

We reserve the right to modify these Terms at any time. For material changes, we will notify registered users by email and/or platform notice at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance. If you do not agree, cease using our services before the effective date.

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law provisions. Any dispute shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the competent courts of Switzerland.

Users located in the European Union retain the right to bring claims before the consumer protection authorities or courts of their member state of residence, where applicable under mandatory EU consumer law.
